CONTRACT OF SALE

This contract consisting of two (2) pages is for the sale of one UKC registered American Pit Bull Terrier Dog from TRUE KENNELS to Buyer indicated at the end of Contract

Contract reads as follows:

1.       Cost

  1. Cost, indicated above, _____________ is due before the dog reaches 8 weeks of age.  

  2. If litter does not produce enough quality or suitable pups of show potential to fulfill expectations, the deposit will be transferred to our next breeding or be returned to buyer.  Buyer will be responsible for any difference in total price of puppy from next litter.   

  3. A late fee of $100 will be applied if paid between the ages of 8-10 weeks.

  4. If said dog is not paid for in full by 10 weeks of age the potential ownership of dog, $350 deposit, $100 late fee, and any money paid not toward the total sale price of dog (ex. Ear crop) will be forfeited to TRUE KENNELS.  All other money will be refunded to Buyer.

2.       Ownership

  1. When introduced into new surroundings, dogs are sometimes inclined to exhibit shyness and inactivity.  In some instances they may refuse to eat.  After becoming adapted to their new homes they will readily accept you as their new master and overcome the shyness of the new quarters.  You as the new owner have a great responsibility to maintain your dog’s emotional and physical well-being.  

  2. Owner must allow representative(s) of TRUE KENNELS to visit and/or inspect their homes for the well-being of the dog.  This visit/inspection is to be done at any time.  TRUE KENNELS will contact you no less than three (3) days prior to the planned visit/inspection to your home.

  3. Said dog must be owned, possessed, and kept by the Buyer.

  4. Dog is not to be co-owned, given, or shared ownership with anyone without approval from TRUE KENNELS.  If approved the new co-owner must sign and agree to all terms on the Contract of Sale with TRUE KENNELS.

  5. If buyer decides to sell said dog it must be offered back to TRUE KENNELS first.  The amount paid for the return of the dog is at the discretion of TRUE KENNELS.  This is for the life of the dog regardless of how much money has been spent on the dog.

  6. If TRUE KENNELS declines to purchase dog back then said dog may be sold at the buyer’s discretion.

·         If said dog is sold at buyer’s discretion a copy of TRUE KENNELS current Contract of Sale must be signed by the new buyers before papers are transferred into their name.  They must agree to all items on the contract with TRUE KENNELS.

3.       Health

  1. All dogs leave TRUE KENNELS in good health and current on all vaccines.

  2. Buyer is to take pup/dog for a health check up to a licensed Veterinarian within 48 hours of obtaining it from TRUE KENNELS.  Buyer must provide TRUE KENNELS with a full report.

  3. All dogs carry a guarantee on “genetic” health defects and/or problems; this guarantee is against any inherited disorders that would shorten the normal life span of the said dog.   TRUE KENNELS will replace the dog owner with another dog with similar characteristics.  This is at a later time at the discretion of TRUE KENNELS.   It will be the choice of TRUE KENNELS if the original dog in a replacement situation shall be neutered and left with the owner or returned alive and in good condition to TRUE KENNELS with a statement from a licensed Veterinarian stating the problem.  The health problem cannot be due to nutrition, improper exercise, fighting, or bad care. All shipping fees to be covered by Buyer.  This expires after one year of ownership.

  4. If death is caused by accident or poisoning, purchase price will not be refunded.  TRUE KENNELS will not be responsible for any veterinarian bills or other bills the owner may incur after the purchase of the dog.

  5. Vaccines must remain current.

  6. Clean water must be available at all times, adequate quality food must be given, and animal must be kept in a clean and secure enclosed yard or large kennel with appropriate amount of shade and shelter.

  7. Dogs must never be abused, neglected, or mistreated.

  8. If at anytime during ownership the local law enforcement/animal control feels that the dog is not being properly cared for, TRUE KENNELS has the option to confiscate the dog immediately and without any compensation due to Buyer, and full Registration paperwork must be signed and given back to TRUE KENNELS.

4.       Breeding

  1. If said dog has not received a UKC Championship title in Conformation prior to planned breeding, dog must first be physically inspected by a representative(s) of TRUE KENNELS to determine breeding potential.

·         If said dog is determined not breeding material due to major or genetic fault(s) such as undershot bite it must be spayed/neutered.  Documentation of the spay/neuter procedure from a licensed Veterinarian is to be presented to TRUE KENNELS no later than 3 months after this determination has been made.

  1. Dog being purchased must never be breed to any other dog unless it is a pure bred, and registered  (papered) UKC American Pit Bull Terrier.

  2. Dog must receive a satisfactory score from either OFA or Penn-Hip before breeding.  This and all other medical testing to be completed and presented to TRUE KENNELS by the new owner prior to breeding.

  3. Females may never be bred before their third heat and/or before 2 years of age which ever occurs first.  Also, they are not to be bred back-to-back heats unless approved by TRUE KENNELS.

  4. All  females may only have a maximum of four litters and not be bred over the age of seven years, unless approved by TRUE KENNELS.

  5. In the event a buyer decides to breed said dog, the buyer will take all necessary precautions to ensure a healthy quality litter.  They also agree to follow the United Kennel Club’s Breeder Code of Ethics.  

  6. TRUE KENNELS reserves five (5) free breedings to all Males sold.

·         These free breedings may be used at any time to any five females of our choice.

·         TRUE KENNELS will cover all breeding expenses related to our free breedings.

·         Any free breeding that does not result in at least three live puppies will not be deducted from TRUE KENNELS five free breedings.  In this event both parties will still sign the litter registration.

5.       Name

  1. All dogs purchased must keep “TRUE” in the registered name for the life of the dog.

  2. If after purchase the buyer decides to change the registered name, the new registered name must be reported to TRUE KENNELS. 

6.       All dogs from TRUE KENNELS must never be used for any illegal purposes.

  1. If dog is used for illegal purposes it will be immediately removed from the home and all registration papers signed and forfeited to TRUE KENNELS.  Criminal charges will then be filed with the proper authorities.  UKC will be notified.

  2. This includes fighting, rolling, or facing off dog with any other animal or dog.

7.       Keeping us updated

  1. If the buyer of dog decides to relocate, new address and phone number must be supplied to TRUE KENNELS.

  2. Buyer is to contact True Kennels at least every 4 months with updates on the dog’s progress, provide current pictures and show result.

IF ANY PART OF THIS CONTRACT IS BROKEN, THE FULL OWNERSHIP (PAPERS) AND POSSESSION OF THE DOG WILL BE RETURNED TO TRUE KENNELS.  THE UNDERSIGNED BUYER, TRUE KENNELS ACKNOWLEDGE THAT THIS IS A LEGAL AND BINDING CONTRACT AND HAVE RECEIVED A SIGNED COPY.  IF THIS CONTRACT IS BROKEN AND DOG IS NOT RETURNED TO TRUE KENNELS WITH SIGNED REGISTRATION PAPERS THE BUYER WILL BE LIABLE FOR CIVIL DAMAGES IN THE AMOUNT TO BE DECIDED BY TRUE KENNELS.  THIS CONTRACT HERE BY GIVES TRUE KENNELS PERMISSION TO REPOSSESS SAID DOG IF ANY PART OF THIS CONTRACT IS BROKEN.
